In 1988 the California Supreme Court made a seminal decision limiting the scope of a key provision of the state Insurance Code and overruling an earlier Supreme Court decision. This new ruling, Moradi-Shalal v. Fireman's Fund Insurance Companies 46 Cal.3d 287, held that it is perfectly legal for an insurance company to deal with a person who its insured has injured in bad faith (Surprised? This is not to say that every claims representative will treat you unfairly, but many can be quite unreasonable so it is most often helpful to have legal assistance, which Marvin Pederson's office will give.
There are a few important things to remember when you are injured are to make a report of the injury soon after it happens:
- If you are hurt see a doctor - don't try to tough it out
- Follow your doctors' orders carefully
- Keep all of your receipts and records in an organized file
- Don't post about your case on social media
